Terms & Conditions
These Terms govern your access to and use of the PhotosPosse website, creative services, digital services, pricing, orders, revisions, payments, delivery, app access and communications.
1. Services Covered
PhotosPosse provides creative and digital services including graphic design, branding, logo design, photo editing, video editing, motion graphics, website design, website development, social media creatives, marketing materials, presentation design, multimedia production, AI-assisted creative services, training-related creative work and custom digital solutions.
The exact scope depends on the package, Shopee listing, invoice, price confirmation, written instruction, chat conversation or project confirmation agreed between PhotosPosse and the Client.
2. Communication & Valid Instructions
We may communicate through WhatsApp, Telegram, email, website forms, Shopee Chat, social media messages, phone calls, app notifications or dashboard updates.
Instructions, approvals, revisions, pricing confirmations, file submissions and delivery confirmations made through these channels are considered valid and may be relied on by PhotosPosse.
3. Pricing, Orders & Acceptance
Pricing may be given through a formal quotation, invoice, Shopee listing, payment link, WhatsApp message, Telegram message, email, social media message or written confirmation.
You are deemed to have accepted the price and scope when you make payment, place an order, submit files, instruct us to proceed, approve commencement or otherwise act in a way that confirms acceptance.
We are not required to issue a formal quotation for every order, especially for standard, urgent, small-value, customised, chat-based or Shopee-based transactions.
4. Payment Terms
Payment may be accepted through Shopee, Stripe-supported payment gateway, credit card, debit card, bank transfer, DuitNow, e-wallet or any other approved method.
Unless otherwise agreed, payment must be made before work starts. Final files, editable files, website access, high-resolution exports or project handover may be withheld until all outstanding payments are fully settled.
We are not responsible for bank delays, payment gateway failures, card charges, Shopee fees, Stripe fees, currency conversion charges or third-party transaction issues.
5. Commencement of Work
Work is considered started once we begin reviewing your requirements, assigning the project, organising files, preparing drafts, editing, designing, developing, rendering, using software, using AI-assisted tools, or communicating internally or externally for project execution.
Once work has commenced, cancellation and refund requests are subject to our Refund Policy.
6. Client Responsibilities
- Provide accurate instructions and complete project details.
- Provide all required logos, photos, videos, text, references and brand materials.
- Ensure all supplied materials are lawful and authorised for use.
- Review drafts and final deliverables carefully before approval.
- Provide clear feedback within a reasonable time.
- Ensure approvals are given by an authorised person.
PhotosPosse is not responsible for delays, errors or additional costs caused by incomplete information, low-quality files, delayed replies or changes in direction.
7. Revisions
Revision entitlement depends on the service, package, listing, written agreement or project scope. Unless stated otherwise, revisions apply only to minor amendments within the original agreed scope.
Where “unlimited minor revisions” are offered, this means up to ten (10) minor revision rounds unless otherwise agreed in writing. It does not include unlimited redesigns, new concepts, new formats, additional pages or major changes in direction.
PhotosPosse reserves the right to determine whether a requested change is within the agreed revision scope.
8. Delivery Timelines
Delivery timelines are estimates unless expressly confirmed as guaranteed in writing. Timelines may be affected by project complexity, client response time, revisions, public holidays, technical issues, file quality, third-party delays, queue status or change of scope.
PhotosPosse is not liable for loss or damage caused by delay where reasonable efforts have been made to complete the work.
9. Approval & Acceptance
You are responsible for checking all drafts and final deliverables before approval, including spelling, grammar, names, dates, prices, contact details, layout, brand colours, technical content and final format.
Once you approve a deliverable, it is deemed accepted. Any amendment requested after approval may be treated as additional work and charged separately.
10. Intellectual Property
Ownership of final approved deliverables transfers to you only after full payment is received. Until full payment is made, all work remains the property of PhotosPosse / MAHA ASIA MEDIAWORKS.
PhotosPosse retains ownership of drafts, unused concepts, working files, internal templates, editing methods, AI prompts, workflows, production methods, source structures and preliminary outputs.
Unless confidentiality is agreed in writing, we may display completed public-facing work in our portfolio, website, social media, case studies, presentations or marketing materials.
11. Editable Files & Source Files
Editable files, source files, raw files, project files, layered files, development files, design systems, templates, AI prompt files and internal production files are not included unless expressly agreed in writing before work begins.
Final deliverables may be provided in export formats such as JPG, PNG, PDF, MP4, GIF, ZIP or other agreed formats. Editable or source files may be charged separately.
12. Website & Digital Services
For website services, content must be supplied by the Client unless content writing is included. Hosting, domains, plugins, themes, licences, subscriptions and third-party tools may incur separate charges.
We do not guarantee traffic, SEO ranking, sales, leads, conversions, platform approval or business results. Future website issues caused by hosting failure, expired licences, malware, plugin conflicts, third-party updates or client-side changes are not our responsibility unless maintenance is separately engaged.
13. Prohibited Content
We may refuse or terminate work involving unlawful, misleading, defamatory, fraudulent, abusive, obscene, hateful, discriminatory, infringing, exploitative, sexually explicit or otherwise inappropriate content.
You are responsible for the legality and accuracy of all content, claims, products, services and representations used in final deliverables.
14. Limitation of Liability
Nothing in these Terms limits liability that cannot legally be limited under Malaysian law, including statutory consumer rights where applicable.
Subject to applicable law, PhotosPosse and MAHA ASIA MEDIAWORKS are not liable for indirect loss, loss of profit, loss of revenue, business interruption, reputational damage, platform-related loss, data loss, third-party claims, client error or AI tool limitations.
Our total liability for any service is limited to the amount actually paid by you for the specific service giving rise to the claim.
15. Governing Law
These Terms are governed by the laws of Malaysia. Parties should first attempt to resolve disputes amicably through direct discussion or negotiation.
Where applicable, consumer remedies under Malaysian law remain available. Subject to such rights, the Courts of Malaysia shall have jurisdiction over disputes.

We may also collect technical data such as IP address, browser type, device type, operating system, pages visited, referral source, form interaction, cookies and analytics data.
2. How Information Is Collected
Information may be collected when you visit our website, submit forms, contact us through WhatsApp, Telegram, email, social media or Shopee, make payment, upload files, use our app/dashboard, subscribe to updates or engage our services.
3. Purpose of Collection
We may use your information to respond to enquiries, provide pricing, process orders, verify payments, deliver services, assign work to our team, prepare deliverables, manage revisions, provide support, process refunds, maintain records, improve services, protect our rights, comply with legal obligations and send service-related or marketing communications.
4. Project Files & Materials
Project files may be accessed by our internal team, editors, designers, developers, contractors or authorised service providers where necessary to complete the service.
You should not submit sensitive personal data unless required for the project. You are responsible for ensuring all submitted materials are lawful and authorised for use.
5. Payment Information
Payments may be processed through Shopee, Stripe-supported payment gateways, banks, cards, DuitNow, e-wallets or other approved methods. We may store payment proof, transaction references, order numbers, invoices and billing records.
Full card numbers are processed by third-party processors and are not stored directly by PhotosPosse unless required and permitted by the payment provider.
6. Sharing of Information
We may share information with staff, editors, designers, developers, freelancers, contractors, payment processors, Shopee, Stripe, banks, hosting providers, cloud storage providers, website tools, analytics platforms, advertising platforms, accounting advisers, legal advisers or authorities where necessary.
7. Data Storage & Security
Information may be stored through email systems, cloud storage, website systems, order platforms, app dashboards, project tools, local devices and internal business systems.
We take reasonable steps to protect data, but no electronic transmission or storage system is completely secure.
8. Data Retention
- General enquiries may be retained up to 12 months.
- Project files may be retained up to 24 months.
- Payment, invoice and tax records may be retained up to 7 years.
- Legal, dispute or compliance records may be retained as long as necessary.
You are responsible for downloading and safely storing final deliverables after delivery.
9. Marketing Communications
We may send service updates, promotions, campaigns, Shopee updates, WhatsApp updates, Telegram updates, newsletters, ads or retargeting messages. You may request to stop marketing communications, but we may still contact you regarding active orders, legal notices, support or payment matters.
10. Your Rights
Subject to applicable law, you may request access to personal data, correction of inaccurate data, withdrawal of marketing consent, deletion of certain data or information about how your data is used.
Some requests may be limited where data is required for legal, accounting, tax, dispute, fraud prevention or operational purposes.
Refund Policy
This Refund Policy explains how refund requests are handled for creative services, digital services, training, courses and premium shoots.
1. General Refund Principle
Most PhotosPosse services involve time, labour, creative work, software use, AI-assisted tools, file review, planning, team allocation and custom production. Because the work is made specifically for you, refunds are generally not available after work has started.
2. When Work Is Considered Started
Work is considered started once we review instructions, assign the project, download or organise files, prepare drafts, create concepts, edit, design, develop, render, use software or AI tools, or communicate internally for execution.
3. Non-Refundable Services
- Custom graphic design, logo design and branding.
- Photo editing, video editing and motion graphics.
- Website design and development.
- Presentation design and social media creatives.
- AI-assisted creative work and custom multimedia work.
- Urgent or rush orders.
- Completed or partially completed creative work.
4. Refunds Before Work Starts
If cancellation is requested before any work starts, we may consider a refund. Approved refunds may be deducted for Shopee fees, Stripe fees, gateway charges, bank charges, administrative fees, third-party costs or currency conversion charges.
5. No Refund After Drafts or Deliverables
Refunds will generally not be provided once a draft, preview, concept, edited file, website layout, video render, partial deliverable, AI-assisted output or final deliverable has been prepared or shared.
6. Change of Mind
Refunds are not provided due to change of mind, choosing another provider, delay in your response, change in business direction, failure to provide required information, unsuitable files or no longer needing the service.
7. Revisions Are Not Refund Grounds
Refunds will not be provided simply because revisions are requested. Revisions will be handled according to the agreed package, scope or listing. Major changes, new concepts or out-of-scope requests may incur additional charges.
8. Abandoned Projects
If you fail to respond, provide required materials, give feedback or approve deliverables within fourteen (14) days from our last communication, the project may be treated as inactive or abandoned. Payments for abandoned projects are non-refundable once work has commenced.
9. Shopee, Stripe & Third-Party Payments
For Shopee orders, Shopee platform rules may apply in addition to this Refund Policy. For Stripe, card, bank or e-wallet payments, refund timelines and deductions may depend on banks, gateways, Shopee, Stripe or card issuers.
10. Training, Courses & Luxury Shoots
Training, courses, workshops and luxury or premium shoots may require a non-refundable booking deposit. The deposit secures your date, slot, crew, equipment, preparation and capacity.
Rescheduling may be allowed subject to availability and reasonable notice, preferably at least thirty (30) days. No-shows are treated as completed bookings and are non-refundable.

3. Client Final Review Responsibility
You are responsible for checking all final deliverables before use or publication, including names, spelling, dates, prices, claims, contact details, legal wording, brand colours, website content and final file format.
Once approved, deliverables are deemed accepted.
4. AI-Assisted Tools
We may use AI-assisted tools, automation, templates, stock assets, plugins and creative software. AI-assisted output may vary due to tool limitations, source-file quality, prompt limitations and third-party restrictions.
5. Third-Party Platforms
We are not responsible for downtime, restrictions, rejected ads, account suspensions, algorithm changes, payment issues, hosting issues, policy changes or failures caused by third-party platforms including Shopee, Stripe, WhatsApp, Telegram, Meta, Google, TikTok, hosting providers, plugins or AI tools.
6. Portfolio, Samples & Past Results
Portfolio items, mockups, samples, previews, case studies, testimonials and past projects are for reference only. They do not guarantee the same outcome, design result, audience response or business performance for every client.
7. Client-Supplied Materials
You are responsible for ensuring that all photos, videos, logos, fonts, music, voiceovers, product information, website content, personal images, claims and documents supplied to us are accurate, lawful and authorised.
8. Boss Vee Character Notice
Boss Vee is a fictional PhotosPosse brand mascot used for storytelling, branding and customer engagement. Boss Vee does not represent a real person, employee, director, photographer or business owner. Any resemblance to real persons is purely coincidental.

App / Dashboard Terms
These terms apply to any PhotosPosse client app, order tracker, seller dashboard, editor dashboard, internal dashboard, file portal or project management system.
1. Dashboard Access
PhotosPosse may provide dashboard, app or portal access to clients, editors, sellers, staff, contractors or authorised users for order tracking, project updates, file handling, communication and internal management.
Access is a privilege and may be changed, restricted, suspended or removed at any time for security, misuse, account risk, policy breach, inactivity or operational reasons.
2. Account Responsibility
You are responsible for keeping your login details secure. You must not share access with unauthorised persons, allow another person to misuse your account or attempt to access restricted areas.
Any activity carried out through your account may be treated as authorised unless you notify us promptly of suspected unauthorised access.
3. Order Tracking Accuracy
Dashboard order statuses, progress updates, task notes, deadlines and internal comments are provided for convenience and coordination. They may not always reflect real-time progress.
Official scope, pricing, approval, payment and delivery terms remain governed by written confirmation, invoice, Shopee order, email, WhatsApp, Telegram, support message or other official communication.
4. Editor / Seller Dashboard Usage
Editors, sellers, staff and contractors must use the dashboard only for authorised PhotosPosse work. They must not misuse client files, copy confidential information, contact clients directly without authorisation, bypass PhotosPosse processes or manipulate order records.
PhotosPosse may audit dashboard activity, restrict accounts, remove access or take action for misuse.
5. Uploaded Content Rules
You must only upload files that you own, control, are authorised to use or have legal permission to submit. Uploaded files must not contain unlawful, infringing, abusive, harmful, fraudulent, explicit, exploitative or prohibited content.
PhotosPosse may remove or reject files that breach these terms or appear unsafe, unlawful or inappropriate.
6. Activity Logs & Audit Trail
The app or dashboard may record activity logs including login time, user actions, file uploads, file downloads, order status changes, messages, approvals, timestamps, IP details or device information.
These logs may be used for security, dispute resolution, quality control, audit, project tracking and internal administration.
7. System Availability
We do not guarantee uninterrupted, error-free or always-available dashboard access. The system may be unavailable due to maintenance, hosting issues, upgrades, bugs, security action, internet problems, third-party downtime or technical errors.
Dashboard downtime does not automatically entitle you to refunds, compensation or cancellation of service unless required by law.
8. Suspension & Misuse
PhotosPosse may suspend or terminate dashboard access if there is suspected misuse, unauthorised access, abusive behaviour, breach of confidentiality, file abuse, payment dispute, security risk, policy breach or any action that may harm PhotosPosse, clients, editors or systems.
9. Beta Features
Some app or dashboard features may be experimental, beta or under development. These features may change, break, be removed, produce incomplete data or require manual correction.
Beta features are provided without guarantee of accuracy, availability or suitability for every project.
AI Usage Disclosure
This disclosure explains how PhotosPosse may use AI-assisted tools, automation and creative software in project delivery.
1. Use of AI-Assisted Tools
PhotosPosse may use AI-assisted tools, automation, editing software, design tools, stock assets, plugins, templates, scripts and digital workflows to support creative work, speed up production, improve quality or generate ideas.
2. Examples of AI-Assisted Work
- Image cleanup, enhancement, background removal or upscaling.
- Creative concept generation and layout exploration.
- Text drafting, rewriting or content structuring.
- Video, image or audio workflow support.
- Automation for dashboards, reporting or project operations.
- Design variation, mockup generation or reference preparation.
3. AI Output Limitations
AI-assisted output may not be perfect, original in every element, free from artefacts, suitable for every use case, identical to references or free from technical limitations. Output quality may depend on source files, prompt quality, platform restrictions, model limitations and client instructions.
4. Human Review
Where appropriate, PhotosPosse applies human creative judgment, editing and review. However, you remain responsible for reviewing and approving final deliverables before use, publication or printing.
5. AI Prompts, Workflows & Internal Methods
AI prompts, workflow steps, internal methods, tool settings, editing history, raw AI outputs and production processes are not included as deliverables unless expressly agreed in writing.
PhotosPosse is not required to disclose internal prompts, source structures, tool history, software settings or proprietary workflows.
6. Third-Party AI Platforms
AI tools may be operated by third-party providers. Their terms, privacy rules, restrictions, availability and output limitations may apply. PhotosPosse is not liable for third-party AI platform downtime, changes, restrictions or technical failures.
7. Client Responsibility
You are responsible for ensuring that AI-assisted deliverables are suitable for your intended use and comply with applicable laws, platform rules, brand guidelines, advertising rules and industry requirements.
Client File & Data Policy
This policy explains how PhotosPosse handles uploaded files, client materials, project assets, downloads, storage, retention and deletion.
1. Files You May Provide
You may provide photos, videos, logos, documents, brand files, website content, social media links, product images, audio, references, fonts, login details or other project-related materials.
2. Legal Right to Use Files
You confirm that all files and materials supplied to us are legally owned, licensed, authorised or permitted for use. You are responsible for copyright, trademark, privacy, consent and licensing issues relating to submitted materials.
You agree to indemnify PhotosPosse against claims arising from files or materials you provide.
3. Access by Team Members
Your files may be accessed by PhotosPosse staff, editors, designers, developers, contractors, support team members or authorised service providers where necessary to complete the project.
Team members are expected to use files only for authorised project purposes.
4. Storage Locations
Files may be stored in email, cloud storage, website systems, dashboard systems, project management tools, local devices, backup systems or third-party file platforms used for business operations.
5. File Retention
Project files may generally be retained up to twenty-four (24) months after project completion, unless deleted earlier or retained longer for legal, accounting, dispute, support, portfolio or operational reasons.
PhotosPosse is not obligated to store your files permanently. You are responsible for downloading and keeping your own backup of final deliverables.
6. File Deletion
You may request deletion of certain project files. Deletion may be limited where files are required for legal, accounting, tax, dispute, audit, backup, security or operational reasons.
Deleted files may still remain temporarily in backups, logs or third-party systems until normal deletion cycles are completed.
7. Download Links & Expiry
Download links may expire or be removed after a reasonable period. PhotosPosse may charge additional fees to retrieve, re-export, re-upload or resend old files, especially if the project has already been completed or archived.
8. Sensitive Files
You should avoid sending highly sensitive personal data unless it is strictly required for the project. If sensitive information is needed, you should inform us clearly and provide only what is necessary.
9. Security Limitations
We take reasonable steps to protect files, but no online storage, email, messaging platform, upload portal or cloud system can be guaranteed completely secure. You acknowledge the inherent risks of digital file transfer.
10. Portfolio Use
Unless confidentiality is agreed in writing, PhotosPosse may use completed public-facing work for portfolio, marketing, social media, case studies or promotional purposes. We will not intentionally publish private login details, sensitive unpublished documents or confidential internal materials.
Important Legal Note
These policies are prepared for PhotosPosse website and service operations. They should be reviewed by a qualified Malaysian legal professional before relying on them as final legal documents, especially if the PhotosPosse app/dashboard will process client uploads, payments, editor access, internal order data or personal information at scale.
